Does International Law Apply to the Islamic State?

Is it time to create an international counterterrorism court? The author of this paper believes so, particularly since current international law 1) fails to recognize the hybrid and non-state-like nature of contemporary conflicts; 2) remains entangled in definitional issues that muddy the legal obligations of terrorists and armed forces alike; 3) hasn’t surmounted existing jurisdiction and prosecution problems, and much more.
